• 論文抄録 / 内容記述: 自然人である個人の代理をする AI agent は，自律性が高まるにつれ，その行為が主体である個人の意図通りのものになるとは限らない．その場合，AI agent の行った行為の法律的位置づけが問題になるので，この点に関する諸説を検討する．また，自律性が高い AI agent であれば，直接に人格を与えることはできないにしても，法的に独立した位置づけ，すなわち法人格を与えることも考えられる．AI agent が法人格を持てば，その行為に法的位置づけは明確化できるという利点がある．しかし，法人格を持てるかどうか，ないしは持つべきかという論点がある．この点についてのいくつかの提案を紹介し，その妥当性について検討する．

• 論文抄録(英) / 内容記述: As the autonomy of an AI agent acting on behalf of a natural person, say principal increases, it is not always the case that the agent's actions immediately become what the principal intended. In such a case, the legal status of the AI agent's actions becomes an issue, and we will discuss already proposed theories on this point. If an AI agent is highly autonomous, it is possible to give it a legal personality, even though it is not possible to give it a personality directly. However, there is an issue as to whether it can or should have a juridical personality. Some proposals on this point are presented and their validity is discussed.
