• 論文抄録 / 内容記述: 1996 年通信品位法 230 条は，双方向コンピュータサービス・プロバイダに対して，彼らが媒介する情報に関する強力な免責を認めている．自由なインターネットの発展に寄与したという良い面が評価される一方で，強大な影響力をもつデジタルプラットフォームにこのような強力な免責を認めることに対する批判も大きい．法改正の議論が活発に行われている．しかし，リベラルと保守の意見の隔たりが大きく改正法の成立には至っていない．最近では，通信品位法 230 条の運用に批判的な意見が，裁判官からも出されている．本稿では，通信品位法 230 条に関する訴訟の動向を概観し検討する．

• 論文抄録(英) / 内容記述: Section 230 of the 1996 Communications Decency Act grants strong immunity to interactive computer service providers in relation to the information they mediate. While the positive aspects of its contribution to the development of a free internet are appreciated, there is also significant criticism of granting such strong immunity to powerful and influential digital platforms. There is active debate on amending the law. However, the liberal-conservative divide in opinion has been so great that the revised law has not been passed. Recently, judges have also expressed critical opinions on the operation of Section 230 of the Communications Decency Act. This article provides an overview of developments in litigation concerning Section 230 of the Communications Decency Act and discuss the issues.
