| 内容記述 | データに関するインターオペラビリティ（相互運用性）の確保は，EU のデータ政策における重要な概念であると考えられている．EU がデジタル公共政策では（シングル・デジタル・ゲートウェイ規則，オープンデータ指令，データガバナンス指令，相互運用可能な欧州法案等）は，公的部門における相互運用性の確保が主要な目的になっている．また，データ共有とその活用を目指データ法，デジタル市場における競争環境の整備を目的とするデジタル市場法，個人情報保護制度である一般データ保護規則（GDPR）にも，相互運用性を促進する制度がある．しかし，それぞれの制度が求めるインターオペラビリティの内容は必ずしも明確ではなく，具体的にどのようなデータへのアクセスを確保すべきなのかは，かなり技術的かつ具体的な議論にならざるを得ない．本報告では，EU データ政策におけるデータポータビリティに関する規定を整理し，制度上要求されている内容について検討し，その課題について考察する． | |||||||

| 内容記述 | Interoperability of data is considered a key concept in EU data policy. The EU's digital public policy (e.g., Single Digital Gateway Regulation, Open Data Directive, Data Governance Directive, Interoperable Europe Act), involves ensuring interoperability in the public sectors. The Data Act for facilitating data sharing and its use, the Digital Market Act for creating a competitive environment in the digital market, and the General Data Protection Regulation (GDPR) for personal data protection also have instruments to promote interoperability. However, the interoperability required by each of these regimes is not always clear and often causes a rather technical and specific debate. This paper summarizes the provisions on data portability in EU data policy, examines the content of the institutional requirements and discusses the challenges. | |||||||
