• 論文抄録 / 内容記述: 2022 年 2 月 22 日，欧州データ保護会議（EDPB）は「個人データ移転ツールとしての行動規範に関するガイドライン 04/2021（Guidelines 04/2021 on Codes of Conduct as tools for transfers）」を採択した．本ガイドラインは，2019 年 6 月 4 日に EDPB が採択した「GDPR における行動規範と監視組織に関するガイドライン 1/2019（Guidelines 1/2019 on Codes of Conduct and Monitoring Bodies under Regulation 2016/679）」を補完するものである．GDPR における行動規範制度は，GDPR の適正な適用に貢献する「行動規範（Codes of Conduct）」の作成を，加盟国，監督機関，EDPB 及び欧州委員会が奨励する制度である．本ガイドラインの目的は，GDPR 第 46 条 2 項 (e)に従い，個人データを第三国に移転する際の適切な保護措置として，行動規範に関する GDPR 第 40 条 3 項の適用を特定することである．2023 年 12 月現在，GDPR 第 46 条 2 項 (e)に基づく行動規範は承認されていない．一方，「GDPR における行動規範と監視組織に関するガイドライン」によると，データ移転ツールとしての行動規範は，「GDPR が提供する保護レベルを国際社会でより広く促進・普及させるとともに，第三国へのデータ移転における法令遵守を持続可能にする」とされている．本稿では本ガイドラインを概説し，データ移転ツールとしての行動規範に関する EDPB 意見の動向を紹介する．これを踏まえてデータ移転ツールとしての行動規範が GDPR の国際社会への促進・普及に貢献する可能性を考察する．

• 論文抄録(英) / 内容記述: On February 22, 2022, the European Data Protection Board (EDPB) adopted "Guidelines 04/2021 on Codes of Conduct as tools for transfers". This guideline complements the "Guidelines 1/2019 on Codes of Conduct and Monitoring Bodies under Regulation 2016/679" adopted by the EDPB on June 4, 2019. Under the GDPR, the Member States, the supervisory authorities, the Board and the Commission encourage the drawing up of codes of conduct, which contribute to the proper application of the GDPR. The purpose of the guideline is to specify the application of Article 40-3 of the GDPR relating to codes of conduct as appropriate safeguards for transfers of personal data to third countries in accordance with Article 46-2-e) of the GDPR. As of 2023, no code under Article 46-2-e) has been approved. On the other hand, regarding codes of conduct as data transfer tools, "Guidelines 1/2019 on Codes of Conduct and Monitoring Bodies under Regulation 2016/679," says "approved codes of this nature may result in the promotion and cultivation of the level of protection which the GDPR provides to the wider international community while also permitting sustainable legally compliant international transfers of personal data". This paper provides an overview of the guideline and introduces trends in the EDPB opinion on the Code of Conduct as a data transfer tool. Based on this, the potential of the Code of Conduct as a data transfer tool to contribute to the promotion and cultivation of the GDPR to the international community will be discussed.
