• 論文抄録 / 内容記述: 生成 AI が創作活動に大きな影響を及ぼすことは疑う余地がない．したがって，現行の著作権法規定のもとで生成 AI がどのように適法に利用できるかという問題に関心が集まっている．しかし同時に，生成 AI が創作活動に及ぼす影響も重要な問題である．著作権法の細部は技術革新に応じて調整され，自然権よりも功利主義的社会契約として成立してきた．技術革新にどう対応させるべきかを検討する際には，あらたな技術がどのような影響を及ぼすかを推測する必要がある．しかし新たな技術的法的条件のもとで，利害関係者がどのような挙動をとるかは大変予想が難しい問題であり，様々な側面からの検討を行うことが望ましい．本報告ではナッシュ均衡下創作物の利害関係者がとりうる行動についてまず考察する．そしてそのような均衡に生成 AI がどのような影響を与えるかを分析する．現行法やその改正の可能性の元で，生成 AI が創作活動にどのような影響を及ぼすかをより正確に予想することで，生成 AI を利用した創作活動やその利用をより生産的なものとするための示唆が得られることを期待する．

• 論文抄録(英) / 内容記述: There is no doubt that generative AI will have a significant impact on creative activities. Therefore, there is a growing interest in the question of how generative AI can be used legally under current copyright law provisions. However, at the same time, the impact of generative AI on creative activities is also an important issue. The details of copyright law have been adjusted in response to technological innovation, and it has been established as a utilitarian social contract rather than a natural right. When considering how to respond to technological innovation, it is necessary to estimate what kind of impact the new technology will have. However, it is very difficult to predict how stakeholders will behave under new technical and legal conditions, and it is desirable to consider this from various aspects. In this report, we first consider the actions that stakeholders of a creation can take under Nash equilibrium. We then analyze how generative AI affects such an equilibrium. By more accurately predicting how generative AI will affect creative activities under the current law and its possible amendments, we can make creative activities using generative AI and its use more productive. We hope that this will give you some suggestions for this purpose.
