• 論文抄録 / 内容記述: 2023 年 7 月 10 日，欧米データプライバシーフレームワーク（EU-US Data Privacy Framework）に対して，欧州委員会の十分性認定がなされた（COMMISSION IMPLEMENTING DECISION of 10.7.2023 pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the adequate level of protection of personal data under the EU-US Data Privacy Framework）．欧州委員会によれば，「欧米データプライバシーフレームワークは，米国の諜報機関による欧州のデータへのアクセスを必要かつ適切なものに制限することや，欧州の個人がアクセスできるデータ保護審査裁判所（DPRC）の設立など，欧州司法裁判所が提起したすべての懸念に対処するための拘束力のある新たな保護措置を導入している．新しいフレームワークでは，プライバシー・シールドの下に存在していたメカニズムと比較して，大幅な改善が導入されている．」とされており，欧州委員会の考えるガバメント・アクセスについての水準が示されるとともに，公的部門についての十分性認定の拡張を目指す我が国にとっても有益な示唆を含む．本発表では，欧米データプライバシーフレームワークに対する十分性認定を分析し，我が国のデータ保護制度への示唆を得る．

• 論文抄録(英) / 内容記述: On 10 July 2023, a European Commission Adequacy Decision was made for the EU-US Data Privacy Framework (COMMISSION IMPLEMENTING DECISION of 10.7.2023 pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the adequate level of protection of personal data under the EU-US Data Privacy Framework). According to the Commission, “ The EU-U.S. Data Privacy Framework introduces new binding safeguards to address all the concerns raised by the European Court of Justice, including limiting access to EU data by US intelligence services to what is necessary and proportionate, and establishing a Data Protection Review Court (DPRC), to which EU individuals will have access. The new framework introduces significant improvements compared to the mechanism that existed under the Privacy Shield. " It is stated that the European Commission's level of government access is set out, and includes useful suggestions for Japan, which aims to extend the Adequacy Decision with regard to the public sector. This presentation analyses the Adequacy Decision for the EU-US Data Privacy Framework and provides suggestions for Japan's data protection system.
