有料コンテンツの講義内での活用とオンデマンド受講への対応

• 論文抄録 / 内容記述: 著作権法 35 条が LMS の浸透とコロナ禍により，改正時に補償金等を前提として「有料著作物の講義教室外からの受講・視聴」を含めた異時公衆送信への対応を果たした．一方でコロナ禍において学生の受講スタイルの 1 つとして定着したものが「オンデマンド受講」である．また，それ以外にも公欠や診断書付き病欠等，欠席に対し「理解の」配慮の必要な事案もあるため，有料著作物の利用時には対応が必要になる．そこで本報告では有料コンテンツの講義内での活用と，オンデマンド受講においてどういうことが重要となるのかについて実践を基にした報告を行う．オンデマンド受講では通常と受講時間が異なる関係で，その配慮には対面のみの講義とは異なる配慮が必要になる．

• 論文抄録(英) / 内容記述: Article 35 of the Copyright Act has been amended to accommodate heterogeneous public transmission, including "attendance and viewing of paid works from outside the lecture classroom," based on the assumption of compensation at the time of the amendment, due to the penetration of LMS and the Corona disaster. On the other hand, "on-demand attendance" has become one of the established styles of attendance by students due to the Corona disaster. In addition, there are other cases that require "understanding" of absences, such as public absences and sick absences with medical certificates, which need to be taken into consideration when paid works are used. In this report, we present a report on the use of paid content in lectures and what is important in on-demand courses, based on practical experience. On-demand lectures require different considerations from face-to-face lectures because of the difference in the lecture time from the usual ones.
