• 論文抄録 / 内容記述: 2021 年 12 月，英国は英電気通信（セキュリティ）法（Telecommunications (Security) Act 2021）を成立させた．この法律は通信事業者に対して一定のセキュリティ対策を義務づけるものである．その中には典型的には中国ベンダーの Huawei などの高リスクベンダーの排除も含まれている．もっとも，情報セキュリティ法学から見てこの法律が特徴的なことはこういった義務の違反に対して通信当局が罰金及び調査の権限を有する点である．従来，情報セキュリティでは任意の「ベースライン・アプローチ」が取られることが多かったが，新法は一定の情報セキュリティ対策を制裁をもって義務づけているのである．こういった「ベースライン・アプローチからの転換」とも呼べる現象は近時，英国以外でも生じているが，本法は最も強力なものと思われる．そのため，本研究では本法を調査し，情報セキュリティの義務化に向けた議論の資料を提供する．

• 論文抄録(英) / 内容記述: In December 2021, the UK passed the Telecommunications (Security) Act 2021. This act requires telecom operators to take certain security measures. This includes the elimination of high-risk vendors, typically Huawei of chinese vendor. However, what is unique about this law from the perspective of information security law is that the telecom authorities have the power to investigate and fine violations of these obligations. In the past, a voluntary "baseline approach" was often taken for information security, but the new law mandates certain information security measures with sanctions. Such a phenomenon, which can be called a "shift from the baseline approach," has recently occurred also outside the UK, but this law seems to be the strongest one. Therefore, this essay researches this law and provides materials for the discussion toward the mandatory information security.
