• 論文抄録 / 内容記述: 個人情報保護制度には，個人情報の収集・保有を制限し，透明性を高めるルールが設けられている．一方で，伝統的な犯罪捜査では，地道な情報収集が捜査の基本である．個人情報を含めて捜査に関する資料を収集することは，「張込」や「聞込」等の犯罪捜査規範が推奨する伝統的な捜査（第 101 条）の延長線上にあり，任意捜査の原則（第 99 条）からも望ましいと考えられている．本報告では，わが国の警察官が捜査活動の際に守るべき心構えや捜査方法，手続き等を定める犯罪捜査規範が，どのような考え方に基づいて規定されているのかを確認し，個人情報保護の関係について検討する．

• 論文抄録(英) / 内容記述: The personal data protection legislations include rules to limit the collection and retention of personal data and to increase transparency. On the other hand, in traditional criminal investigations, the steady collection of information is basic action and an extension of the traditional investigations recommended by the Code of Criminal Investigations, such as "stakeouts" and "interviews" (Article 101). It is considered desirable from the principle of voluntary investigation (Article 99). This paper focuses on the approach taken by the Code of Criminal Investigations for investigative activities of police officers in Japan and examines the relationship between the Code and the data protection.
