2020 年 12 月 15 日，EU の欧州委員会はデジタルサービス法パッケージとして，デジタルサービス法とデジタル市場法の案を発表した．この新しいパッケージ法は，ユーザーの基本的権利を保護して安全なデジタル空間を確保するとともに，イノベーションの促進や競争力を促進するための市場を創出することをその内容とするとされている．デジタルサービスパッケージの規制対象となるのは，欧州の人口の 10 パーセント以上，すなわち 4500 万人以上を対象としている企業であり，米国の米国の Google，Apple，Facebook，Amazon のいわゆる GAFA は対象となっている．GDPR に加えた規制であり，本法案の内容については日本にも大きな影響を与えるものと考えられるため，現時点における法案のパブコメなどをふまえたドラフトの経緯と課題について検討をおこなう |

On December 15, 2020, the European Commission of the EU announced the draft Digital Services Act and Digital Market Act as a package of Digital Services Law. The new packaging law will protect the basic rights of users, ensure a secure digital space, and create markets to promote innovation and competitiveness. The digital package is targeted at companies targeting more than 10% of the European population, or more than 45 million people, and the so-called GAFAs of Google, Apple, Facebook, and Amazon in the United States. As this regulation has been added to the GDPR and the content of this bill is expected to have a significant impact on Japan, the process and issues of the draft will be discussed based on the public comments of the bill at the present time. |
