| 内容記述 | 厚生労働省が2024年3月に制定した「医療デジタルデータのAI研究開発等への利活用に係るガイドライン」は、医療機関等において診療で得られ、既に保管されている医療情報を利活用することによって、医療機関等、学術研究機関等、及び民間企業等が共同で研究をしながら製品開発を行う場合を想定して制定されている。すなわち、ガイドラインのデータ範囲は主に医療機関内で収集された情報に限定されており、健康アプリやウェアラブルデバイスなどの外部データとの連携についての規定が十分に整備されていない。また、そもそも、ガイドラインという性質上、法的拘束力はない。COVID19を経験し、各国で医療データの取扱いとAI研究開発について規定が整備されつつあるなか、本ガイドラインの法的位置づけを可能な範囲で他国の同様の規定と比較するとともに、データの範囲の取扱いの現状の課題について検討をおこなう。 | |||||||||

| 内容記述 | The "Guidelines on the Utilization of Medical Digital Data for AI Research and Development," issued by the Ministry of Health, Labour and Welfare (MHLW) in March 2024, were formulated with the aim of facilitating collaborative research and product development among medical institutions, academic research organizations, and private enterprises through the utilization of medical data obtained during clinical practice and already stored within medical institutions. The scope of data covered under these guidelines is primarily limited to information collected within medical institutions, with insufficient provisions regarding the integration of external data sources such as health applications and wearable devices. Furthermore, by its nature as a guideline, it does not possess legal binding force. In light of the experiences from the COVID-19 pandemic, various countries have been refining their regulations on the handling of medical data and AI research and development. This study examines the legal positioning of the Japanese guidelines by comparing them, to the extent possible, with similar regulations in other countries, while also identifying and analyzing the current challenges concerning the scope of data covered under the guidelines. | |||||||||
