• 論文抄録 / 内容記述: 個人情報保護法における 「開示等の求め」 の裁判上の請求権性については，肯定説と否定説が存在してきたが，近年，これを否定する新たな裁判例が見られるなどしている．他方，平成 27 年 1 月の通常国会に提出される個人情報保護法の改正案では，確認的と考えるか，創設的と考えるかは別論，請求権性を認める規定が含まれる．本発表では，個人情報保護法における 「開示等の求め」 の裁判上の請求権性につき，新たな裁判例の分析，立法における議論の展開を通し，再考することを試みる．

• 論文抄録(英) / 内容記述: Regarding the Act on the Protection of Personal Information, legal character of Disclosure and other clauses for data subject is discussed. Some court cases accept the making of lawsuits with these clauses. However, we see other court cases that do not accept the lawsuits with the clause. “The Drafted Framework for the Bill of Partial Revision of the Act on the Protection of Personal Information (Tentative)” contains proposal for Disclosure and other clauses to give the character of claim. This study analyses the remedy for access rights on the act on the protection of personal information through the new cases and legislative procedure, and try to give some reconsideration on this matter.
