• 論文抄録 / 内容記述: ISPの巨大サーバに，ユーザによって一片の違法データが記録された場合，現行刑法においてはデータのみの没収は許されない．没収しようとすれば，ISPを没収手続に参加させたうえでサーバのうち違法データが記録された部分を「有体物」として没収することになる．他方，適法なデータを保管しているその他大勢のユーザは没収手続に参加することができない．一片の違法データのためにサーバごと没収されてしまうというISPの負担を軽減しつつ第三者のデータを適切に保護する方法はないだろうか．

• 論文抄録(英) / 内容記述: The current Penal Code does not authorize to seize the subject illegal data alone when an Internet user make recording of certain illegal data in ISP's oversized servers. A confiscation request shall be honored by confiscation of data in certain server as “tangible property,” and the subject ISP must be joined in the preceding seizure. On the other hand, substantial numbers of database users of the foregoing server are not allowed to participate in the confiscation procedure mentioned above. The question here is how to (1) protect the server and third person's data; and (2) mitigate ISP's burden; upon the subject seizure of illegal data, a part of the entire database.
