 note = {今般の製品ライフサイクルの短い時代においては、特許権の早期権利化が重要となる。本稿では、現行の発明の単一性要件・シフト補正の禁止の規定によって、特許権の早期権利化が阻害されている点を指摘すると共に、その解決策を提示する。より具体的には、発明の単一性要件・シフト補正の禁止の運用において重要となる STF の 「直列的な」 認定手法が、出願人にとって酷になるケースを例示し、これを解決する STF の新たな認定手法を提案する。, In this era of short product life cycle recently, it is important to establish a patent right earlier. In this paper, we point out the inhabitation of early establishment of a patent right because of the requirements of unity of invention and the provision to prohibit making an amendment that changes special technical features(STF). Then, we present their solution. Specifically, we illustrate a case that a method of serially-certifying STF works tough for applicants, and propose a new method of certifying STF that resolves above-mentioned problems.},
