• 論文抄録 / 内容記述: コンピュータ・ソフトウェア関連特許の出願が近年盛んになっている。ソフトウェアの法的保護は、著作権法中心の時代から、特許法など種々の法律が補完する知的財産権全体を考える必要がある。しかし、知的財産権を有効に機能させ、必要な法的保護を受けようとする時には、従来型のソフトウェアの管理では十分ではない。ソフトウェアにおける知的財産権を、各財産権分野の特性をまとめた上で再考し、どのような管理が必要となるかを確認する。その上で、企画段階から破棄段階までのソフトウェア・ライフ・サイクル・プロセス(LC)の中でどのように管理を実現するべきかを、SLCPの拡張という形で提案する。

It is necessary to think about the entire intellectual property right which various laws like the patent low etc.. However, it is dissatisfied by the past method of managing software. I propose the expansion of Software Life Cycle Process (SLCP) as one of the control methods of correspondence to a present, intellectual property right.
