| 内容記述 | オーストラリアの 1988 年プライバシー法は，直近では 2022 年に，データ保護機関の権限を拡大する改正がなされているが，本格的な改正については，2023 年 2 月に，司法長官より，個人情報の定義の変更や，中小企業除外の廃止を含む，プライバシー法見直し報告書が公表され，2023 年 9 月には，これに対する政府の応答がなされた．報告書の 116 の提案のうち，無条件で同意したのは 38 項目で，68 項目に「原則的に」同意し，10 項目は「留意」するという内容であったが，2024 年 8 月には新法案が議会に提出されるといわれている．本発表では，2024 年オーストラリアプライバシー法改正法案の動向を中心に報告し，我が国でも行われている個人情報保護法のいわゆる 3 年ごと見直し（第二次）への示唆を得る． | |||||||||

| 内容記述 | Australia's Privacy Act 1988 was most recently amended in 2022 to expand the powers of the Data Protection Authority, but the Privacy Act Review Report was released by the Attorney General in February 2023, including changes to the definition of personal information and the removal of the small business exemption. In September 2023, the government responded to the report. Of the report's 116 recommendations, 38 were agreed to unconditionally, 68 were agreed to “in principle” and 10 were “noted,” but it is said that new legislation will be introduced in Parliament in August 2024. This presentation will focus on the developments in the Australian Privacy Act Amendment Bill 2024, and provide some suggestions for the so-called triennial review (second round) of the Privacy Act, which is also taking place in Japan. | |||||||||
