• 論文抄録 / 内容記述: インターネット上の違法・有害情報の影響が，いっそう深刻になっている．最近では，こういった問題のある情報の拡散を緩和しようとするコンテンツ・モデレーションの取り組みが注目されている．特に EU のデジタルサービス法は，巨大プラットフォームに対して，欧州社会に危機をもたらすようなリスクを低減する努力を求めており，こうした努力にはコンテンツ・モデレーションも含まれると考えられている．一方米国では，事業者による恣意的なコンテンツ・モデレーションを問題視する意見も強く，透明性を高め，行き過ぎた削除等を禁止する州法も制定されている．こうした州法の規制が憲法上の表現の自由を不当に制約するとして訴訟も提起されており，2024 年には連邦最高裁の判決が出ている（144 S.Ct. 2383）．本報告では，こうしたコンテンツ・モデレーションに対する制度的な議論の動向を概観・整理し，今後の課題を検討する．

• 論文抄録(英) / 内容記述: The impact of illegal and harmful information on the Internet is becoming increasingly serious. Recently, content moderation efforts to mitigate the proliferation of such problematic information have seemed to be important. In particular, the EU Digital Services Act requires giant platforms to make efforts to reduce risks that pose a crisis to European society, and these efforts are considered to include content moderation. In the USA, on the other hand, there are strong opinions that arbitrary content moderation by operators is a problem, and state laws have been enacted to increase transparency and prohibit excessive deletion. Lawsuits have been filed claiming that these state laws unfairly restrict constitutional freedom of expression, and in 2024 the US Supreme Court issued a decision (144 S.Ct. 2383). This report provides an overview and summary of the trends in the institutional debate on such content moderation and examines future issues.
