| 内容記述 | 米国における連邦レベルでのデータ保護法の試みは，多くの法案が議会に提出されるものの，成立せずに 2024 年現在に至っているが，2024 年 4 月 7 日，下院エネルギー・商業委員会のキャシー・マクモリス・ロジャース委員長（共和党，ワシントン州）と上院商業・科学・運輸委員会のマリア・キャントウェル委員長（民主党，ワシントン州）が，米国プライバシー権法草案を発表した．これは，州法による「つぎはぎの」規制を排除し，統一的なデータプライバシー権を認めるとともに，連邦取引委員会による執行，個人の損害賠償請求権を定めようとするものであり，今回こそはと，連邦レベルでのデータ保護法の成立が期待されている．本発表では，同草案の概要を解説するとともに，課題を述べる． | |||||||||

| 内容記述 | Although many attempts at data protection legislation at the federal level in the United States have been made in Congress but without passage, as of 2024, on April 7, 2024, House Energy and Commerce Committee Chairwoman Kathy McMorris Rodgers (Republican, Washington) and Senate Commerce, Science, and Transportation Committee Chairwoman Maria Cantwell (Democrat, Washington) released the U.S. Draft Privacy Rights Act. Maria Cantwell (D-Wash.), chairwoman of the House Energy and Commerce Committee, and Senate Commerce, Science, and Transportation Committee, released a draft of the U.S. Right to Privacy Act. The draft legislation seeks to eliminate the "patchwork" of state laws, recognize a uniform data privacy right, provide for enforcement by the Federal Trade Commission, and provide for the right of individuals to seek damages, and it is hoped that this is the time to pass data protection legislation at the federal level. This presentation will give an overview of the draft and discuss the issues involved. | |||||||||
