• 論文抄録 / 内容記述: 近年における情報通信技術（ICT）の発展によって国際的証拠収集の必要性が高まり，国際的ディスカバリが拡大した．特に，米国のディスカバリが他国で保有されている情報に国境を越えて広く適用されるようになり，重要情報流出のリスクが増大している．そのため，日本としても，立法措置や個別訴訟における適切な対応によって，そのような重要情報の国外流出を阻止する必要がある．

• 論文抄録(英) / 内容記述: The development of information and communication technology (ICT) in recent years has increased the need for international evidence collection, and international discovery has expanded. In particular, U.S. discovery has become widely applied across borders to the information retained in other countries, increasing the risk of leakage of critical information. Therefore, it is necessary for Japan to prevent the outflow of critical information through legislative measures and appropriate responses in individual lawsuits.
