• 論文抄録 / 内容記述: 2020 年 11 月 10 日，欧州データ保護会議（EDPB）は “EDPB Document on the procedure for the development of informal “Codes of Conduct sessions”” を採択した．本文書は，GDPR 第 40 条及び第 41 条で規定された行動規範制度に関する文書である．2019 年 6 月 4 日に EDPB が採択した GDPR における行動規範と監視組織に関するガイドラインでは，複数加盟国に適用される行動規範案を所轄監督機関が EDPB に提出する前に，関連する EDPB のサブグループに持ち込んで議論することができると示されている．しかし，本文書は，手続き上の観点から，EDPB に正式に提出されていない文書について，EDPB の専門家サブグループで議論することは適切でないと指摘している．そこで，本文書は，EDPB の正式な権限の範囲外で行う「行動規範セッション」を定め，2019 年 6 月 4 日に EDPB が採択した GDPR における行動規範と監視組織に関するガイドラインの手続き的側面を発展させている．本稿では，本文書を概観し，EDPB に正式に提出される前段階における，EDPB 関与の明確化について検討する．そして，我が国における認定個人情報保護団体制度の課題を検討する．

• 論文抄録(英) / 内容記述: On November 10, 2020, the European Data Protection Board (EDPB) adopted “EDPB Document on the procedure for the development of informal “Codes of Conduct sessions””. This document concerns the Codes of Conduct system provided for in Articles 40 and 41 of the GDPR. “Guidelines 1/2019 on Codes of Conduct and Monitoring Bodies under Regulation 2016/679”, adopted by the EDPB on June 4, 2019, indicate that a draft of the transnational code of conduct could be brought to the relevant EDPB subgroup for discussion before it is submitted to the EDPB by the competent supervisory authority. However, from a procedural point of view, a discussion at an EDPB expert subgroup on a document that has not been formally submitted to the EDPB does not seem appropriate. Therefore, this document develops the procedural aspects of “Guidelines 1/2019 on Codes of Conduct and Monitoring Bodies under Regulation 2016/679”, by establishing “Codes sessions” that will happen outside the formal remit of the EDPB. This paper provides an overview of the document and discusses the clarification of the EDPB's involvement in the previous phase of formal submission to the EDPB. The paper then discusses the issues of the Accredited Personal Data Protection Association system in Japan.
