• 論文抄録 / 内容記述: 個人データを利用する環境は日々多様化してきており，利用主体の観点からも単一事業者による利用に留まらないケースが顕在化してきている．個人情報保護法では共同利用という個人データを取扱うスキームが設けられているが，共同利用については潜脱的な利用につながるという批判的な意見も少なくない．複数事業者をまたいだ個人データ利用のニーズがある中，法が定める共同利用による取扱いには慎重にならざるを得ないという事業者にとっては板挟みの状況がある．一方で，欧州に目を向けると，GDPR では Joint Controller という概念が導入されている．我が国の個人情報保護法制では ControllerとProcessor の概念が導入されていないという違いはあるものの，適正な利用を志向する上では事業者にどのような責務が課されるかは参考になる．本稿では共同利用と Joint Controller の比較をつうじて，現行法下において我が国で考えられる適正な個人データを検討する．

• 論文抄録(英) / 内容記述: In the environment in which personal data is used, cases have emerged in which the use of personal data is not limited to use by a single entity, even from the perspective of the user. The Personal Data Protection Law establishes a scheme for handling personal data through joint use, but not a few critics argue that joint use can lead to undercover use. While there is a need to use personal data across multiple businesses, businesses are caught in a difficult situation, as they have to be cautious about handling personal data through joint use as stipulated by the law. On the other hand, looking at Europe, the GDPR introduces the concept of Joint Controller. Although there is a difference in that the concept of Controller and Processor has not been introduced in Japan's personal data protection legislation, it is instructive to see what responsibilities are imposed on business operators in the interest of appropriate use. This article examines the appropriate personal data that can be considered in Japan under the current legislation through a comparison of joint use and Joint Controller.
