• 論文抄録 / 内容記述: 現在の AI に関わる制度的な課題としては，今後，欧州連合 (EU) 及び米国の AI に関する政策が，ソフト・ローアプローチを模索したものの，ハード・ロー（規制）に向かっている．ソフト・ローアプローチとしての AI のガバナンスについては，AI のリスク対策を組織の自由にはまかせきれず，ハード・ローやむなしという世界の流れがある．本稿では EU AI 規制及び米国 EU 貿易技術評議会 (TTC) 共同ロードマップの規制動向，並びに規格の現状及び課題を踏まえて，今後，日本ではガバナンスによるソフト・ローアプローチが良いことを提案する．

• 論文抄録(英) / 内容記述: As for the current institutional issues related to AI, in the future, EU and US AI policies are heading toward hard laws (regulations), although they have sought a soft law approach. Regarding AI governance as a soft law approach, there is a global trend that AI risk countermeasures cannot be left to the freedom of organizations, and hard laws are inevitable. In this paper, based on regulatory trends of the EU AI ACT and the US-EU Trade and Technology Council (TTC) Joint Roadmap, and the current status and issues of standards, we propose that a soft law approach based on governance is good in Japan in the future.
