• 論文抄録 / 内容記述: 2022 年 5 月に欧州委員会は European Health Data Space（EHDS）に関する法案を提案した．これに対して 7 月，EDPB（European Data Protection Board）とEDPS（European Data Protection Supervisor）はこの法案に対する共同意見を公表した．EHDS は EU の GDPR（General Data Protection Regulation）下においてヘルスデータの活用を進めるのみならず，欧州においてデジタル単一市場を志向して進められるデータスペース構想の第一弾であり，今後の欧州のデータ戦略を大きく左右する動きである．このような中で EDPB，EDPS がデータ保護の視点からどのような意見を出しているかは注目に値する．本報告では，EHDS 法案に対する共同意見を分析し，データ保護の視点から EHDS にどのような疑問が投げかけれ，今後どのようなかたちであれば受容可能であるかについて考察する．

• 論文抄録(英) / 内容記述: In May 2022, the European Commission proposed legislation on the European Health Data Space (EHDS). In response, in July, the European Data Protection Board (EDPB) and the European Data Protection Supervisor (EDPS) issued a joint opinion on the bill. EHDS not only promotes the use of health data under the EU's General Data Protection Regulation (GDPR) but is also the first in a series of data-space initiatives aimed at a single digital market in Europe, a move that will have a major impact on Europe's data strategy going forward. In this context, it is worth noting what the EDPB and EDPS are saying from a data protection perspective. In this report, we analyze the joint opinion on the EHDS bill and consider what questions have been raised about EHDS from a data protection perspective and in what form they may be acceptable in the future.
