• 論文抄録 / 内容記述: インターネット上の名誉毀損やプライバシー侵害に対する法的救済には，損害賠償請求と，差止請求がある．表現行為の差止請求については，表現の自由に対する影響が大きいことから，慎重に判断されるべきという考え方がある．インターネット上の人格権侵害に関して，媒介者に対してどのような場合に削除等の請求が認められるかについては，インターネットが普及し始めた当初から議論がなされてきた．最近も，最高裁判所が，ツイッターに対する削除請求について，グーグルのような検索サービスとは異なる基準で削除を認める判断を示している（最二小判令和 4 年 6 月 24 日）．本稿では，インターネット上の人格権侵害に関する媒介者に対する差止請求について，現在の判例の考え方を整理し，課題を考察する．

• 論文抄録(英) / 内容記述: Legal remedies for defamation and invasion of privacy on the internet include claims for damages and injunctions. There is a view that claims for injunctions against expressive acts should be judged carefully because of their impact on freedom of speech. There has been debate as to when a claim for removal can be made against an intermediary for such infringing acts on the internet. Recently, the Supreme Court ruled that removal claims against Twitter are admissible under different criteria than those against search services such as Google. This article focuses on current case law on injunctive claims for defamation and invasion of privacy on the internet.
