 note = {2022 年 5 月 3 日，欧州委員会は European Health Data Space（EHDS）の設立について，その具体的な内容を公表した．EHDS は欧州における最初のデータスペースであるとされ，今後，同様のデータスペースが続いて提案されることが予想される．EHDS は，既に全面適用が済んでいる General Data Protection Regulation（GDPR），欧州委員会から提案が行われているデータガバナンス法，データ法，加えて Network and Information Systems Directive に基づいているとされている．これは，EHDS が単一の政策分野に留まらないことを意味している．つまり，データスペースのようなデータ活用の場においては，複数の政策分野にまたがった検討が必要であることを示唆している．そこで本稿では，欧州委員会のデジタル戦略をこれらの諸制度を包括的に取り扱うパッケージとして捉えて，全体像の中でデータ保護法制がどのように捉えられているかについて検討する．, On May 3, 2022, the European Commission published the details of the establishment of the European Health Data Space (EHDS). EHDS is the first data space in Europe, and similar data spaces are expected to be proposed in the future. The EHDS is said to be based on the already fully applied General Data Protection Regulation (GDPR), the European Commission's proposed Data Governance Act and Data Act, and the Network and Information Systems Directive. This means that the EHDS is not confined to a single policy area. In other words, in data utilization such as the data space, consideration across multiple policy areas is necessary. In this paper, we consider the Commission's Digital Strategy as a comprehensive package of these institutions and examine how data protection legislation appears in the overall picture.},
