 note = {本論文では,死者のプライバシーという表現について,その実質的な内容を考慮し,死なれてしまった人のプライバシー侵害と表現を変更することを提案する.まず,死者にプライバシーを適用することの奇妙さを死の形而上学の議論を踏まえて指摘する.次に,実際に死者のプライバシー問題が,生きている人間のプライバシー問題であると理解されている兆しを示す.最後に,プライバシーが問題となるのは,誰かに死なれてしまった人に発生することを示す.結果として,死なれてしまった人にプライバシーを還元することで,死者のプライバシー問題を容易に理解できるようになることを述べる., This paper proposes that the expression “privacy of the deceased” should be replaced by the expression “The violation of privacy of the people around someone who dies.” Three arguments are made to demonstrate the necessity of replacing the former expression. First, it argues that applying the concept of privacy to the deceased seems strange based on the metaphysics of death. Second, in actuality the word privacy is often used not only in reference to the deceased but to the people around the deceased. Third, it demonstrates that privacy loss often occurs to the people around somebody who dies. As a result, the concept of the “privacy of the deceased” can be understood more easily only by focusing on the people around someone who dies.},
