2021 年 6 月 16 日，欧州委員会は，韓国に対する欧州一般データ規則（GDPR）上の十分性認定の手続を開始し．同年 12 月 17 日には，十分性決定（COMMISSION IMPLEMENTING DECISION of 17.12.2021 pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the adequate protection of personal data by the Republic of Korea under the Personal Information Protection Act）がなされた．本発表は，EIP 93・94 における発表に続き，欧州委員会による韓国に対する十分性認定手続の現状を分析し，我が国個人情報保護政策への示唆を得るものである．韓国の十分性認定は公的部門，民間部門を併せて認定したものであり，個人情報保護制度の官民一元化をなした日本についても参考になる． |

On June 16, 2021, the European Commission initiated the procedure for an adequacy decision under the European General Data Protection Regulation (GDPR) for the Republic of Korea. On December 17 of the same year, the sufficiency decision (COMMISSION IMPLEMENTING DECISION of 17.12.2021 consumer to Regulation (EU) 2016/679 of the European Parliament and of the Council on the adequate protection of personal data by the Republic of Korea under the Personal Information Protection Act) was made. Following the presentations at EIP 93 and 94, this paper analyzes the current situation of the European Commission's adequacy decision procedure for Korea and provides suggestions for Japan's personal information protection policy. In Korea, both the public and private sectors have been recognized by the adequacy decision, and thus it is also useful for Japan where the private and private sectors have been integrated in the personal information protection system recently to know about the situation. |
