欧州委員会が 2020 年 12 月に公表したデジタルサービス法パッケージは，デジタルサービス法案 (DSA) とデジタル市場 (マーケット) 法案 (DMA) によって構成されており，欧州理事会と欧州議会の決定を経て 2023 年の施行が見込まれている．DSA はプラットフォーム及び公的機関とユーザーの権利を民主主義の観点から再構成するものであり，DMA は，デジタルゲートキーパーとして位置づけられるプラットフォーム事業者による不公正な取引慣行を定義し，禁止し，市場調査に基づいた執行メカニズムを定め，規制から執行まで調和したルールを規定するものである．本立法案は，EU域外も含め，GAFAM 企業，そしてそれ以外の巨大デジタルプラットフォーム企業にとって，非常に大きな影響がある．本発表においては，DMA の具体的内容とそのインパクト，審議状況について検討を行う． |

The European Commission's December 2020 package of digital services legislation, consisting of the Digital Services Bill (DSA) and the Digital Market Bill (DMA), is expected to take effect in 2023 after decisions are taken by the European Council and the European Parliament. The DSA reconstructs platforms and the rights of public authorities and users from a democratic perspective, while the DMA defines and prohibits unfair trade practices by platform operators positioned as digital gatekeepers, establishes enforcement mechanisms based on market research, and establishes harmonized rules from regulation to enforcement. This bill will have a huge impact on GAFAM companies and other large digital platform companies, including those outside the EU. In this paper, the specific content of DMA, its impact, and the situation of deliberation are discussed and analyzed. |
