• 論文抄録 / 内容記述: インターネット上の情報発信によって権利が侵害された場合に，被害者は被害の拡大を防ぐために，情報を媒介している事業者に対して情報の削除を求めることが多い．しかし，インターネット上の媒介者は発信者本人ではないため，削除の可否について判断が難しい場合がある．インターネット上の媒介者については，こうした削除請求への対応プロセスについて特別な制度が整備されている例がある．米国のデジタルミレニアム著作権法におけるノーティス・アンド・テイクダウンがよく知られているが，日本のプロバイダ責任制限法にも発信者に照会をした上でプロバイダが削除を行う制度がある．また，著作権侵害等における信頼性確認団体からの申出も，実質的には削除をスムーズに行うための仕組みであるといえる．さらに，EU のデジタルサービス法案にも，ノーティス・アンド・アクションの規定が置かれている．本報告では，こうしたインターネット上の権利侵害情報の削除プロセスに関する制度の特徴を確認する．

• 論文抄録(英) / 内容記述: The intermediaries on the internet often accept notices about the violation of rights on the Internet. However, since the Internet intermediary is not the sender himself, it is sometimes difficult to judge whether the information can be removed or not. In some cases, there are special procedures in place for Internet intermediaries to handle such notices. Notice-and-takedown under the Digital Millennium Copyright Act in the U.S. is well known, and Japan also has a legal procedure in which the provider removes the material after making an enquiry to the sender. Furthermore, the EU's Digital Services Act also contains a notice-and-action provision. This paper focuses on the comparison of these systems concerning the take-down process of infringing information on the Internet.
