• 論文抄録 / 内容記述: インターネット上で行われる代表的な権利侵害として，名誉毀損，プライバシー侵害，著作権侵害，商標権侵害がある．こうした権利侵害に対する法的救済手段としては，損害賠償請求と差止請求があり，これらの請求は，インターネット上の媒介者であるプラットフォーム事業者，SNS，ISP 等に対しても行われる場合がある．しかし，媒介者に対する差止請求の法的根拠や，請求が認められる要件は，必ずしも明確になっていない．本報告では，インターネット上の権利侵害に対する媒介者への差止請求について，代表的な権利侵害の一つである著作権侵害を中心に現状と課題を考察する．

• 論文抄録(英) / 内容記述: Defamation, invasion of privacy, copyright infringement and trademark infringement are typical infringements of rights on the Internet. Legal remedies for such infringements include claims for damages and injunctions, and these claims may also be brought against Internet intermediaries such as platform operators, social networking services and ISPs. However, the legal basis for injunction claims against intermediaries and the requirements for the recognition of such claims are not always clear. This focuses on issues of injunction claims against intermediaries for infringement of copyrights on the Internet.
