2021 年 6 月 16 日，欧州委員会は，韓国に対する欧州一般データ細規則（GDPR）上の十分性認定の手続を開始したと発表し，同時に，十分性決定の草案を公表した．日本と韓国の社会的，経済的繋がりの強さはいうまでもなく，その関係は重要である．他方，隣国との緊張関係が続く韓国は情報機関等の積極的な活動でも知られる．日本における LINE 事件でも，韓国における一部情報の保存が問題となったが，その評価のためには情報機関等によるパブリックアクセスの制度と運用が問題となる．本発表では，韓国に関する十分性決定草案を分析し，日韓間の個人データ移転についての示唆をも得る． |

On June 16, 2021, the European Commission announced that it had initiated the procedure for determining adequacy under the General Data Protection Regulation (GDPR) for Korea, and published a draft adequacy decision at the same time. The strength of social and economic ties between Japan and Korea is important. On the other hand, South Korea is known for its active activities of intelligence agencies and other organizations due to its strained relations with neighboring countries. In the LINE case in Japan, the preservation of a part of information in Korea became a problem, and the system and operation of public access by information organizations, etc. became a problem for the evaluation. In this paper, the draft adequacy decision on Korea will be analyzed, and suggestions on personal data transfer between Japan and Korea will be made. |
