• 論文抄録 / 内容記述: EU 電子商取引指令（2000 年）には，媒介的サービスプロバイダの責任に関する規定（責任制限規定）がおかれている．しかし，電子商取引指令の責任制限規定に関しては，規定が不明確であることや，EU の各構成国が異なった内容の法律を制定しており，EU 域内の法的安定性と予見可能性を害していることなどの問題点が指摘されてきた．欧州委員会は，デジタルサービス法案を 2020 年 12 月 15 日に公表しており，この法案には，媒介者の責任に関する新たな規定が盛り込まれている．本報告では，デジタルサービス法案の媒介者責任に関する規定を概観し，米国と日本における媒介者責任の議論と比較を行う．

• 論文抄録(英) / 内容記述: The EU Electronic Commerce Directive of 2000 (Directive 2000/31/EC) has provisions that exempt intermediary providers on the Internet from liability for information. However, these provisions have been criticized for being unclear, and some EU member states have enacted laws that do not respect the rule of the directive. The European Commission has proposed "Digital Services Act" on December 15, 2020, which includes new provisions on intermediary liability. This report overviews the provisions on intermediary liability in the proposed Digital Services Act and examines their characteristics and impact.
