These terms are not only requirements for protecting trade secrets and protected data, but also requirements for distinguishing them from “business information” and “business data.” Therefore, first, the history of the trade secret system and the protected data system were reviewed. Secondly, I examined pilot studies and court cases concerning these terms. Furthermore, I analyzed the legal definition of “information” in Japan and the position of “information” as a subject of protection because data producer's rights are being considered as part of the DSM (Digital Single Market) strategy in Europe.
