• 論文抄録 / 内容記述: Schrems II 決定（CJEU Case C-311/18）は欧米間の個人データの移転枠組みであるプライバシーシールドについての十分性認定を無効であるとし，同時に，標準契約約款（Standard Contractual Clauses）に基づく移転についても，「追加的な措置」（supplementary measures）の必要性を示唆した．これを受けて，EDPB（欧州データ保護ボード）は "Recommendations 01/2020 on measures that supplement transfer tools to ensure compliance with the EU level of protection of personal data" を，欧州委員会は "IMPLEMENTING DECISION (EU) …/… of XXX on standard contractual clauses for the transfer of personal data to third countries pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council" のドラフトを，それぞれ公表し，パブリックコメントに付した．本発表は，これら「追加的な措置」及び新たな標準契約約款についての動向を概観するものである．

• 論文抄録(英) / 内容記述: Schrems II decision (CJEU Case C- 311/18) made the sufficiency recognition on the privacy shield which was the transfer frame of the personal data between Europe and America invalid, and simultaneously, it indicated the necessity of transfer based on Standard Contractual Clauses of “supplementary measures". Based on the decision, EDPB (European Data Protection Board) announced "Recommendations 01/2020 on measures that supplement transfer tools to ensure with the EU level of protection of personal data", and European Commission announced the draft of "IMPLEMENTING DECISION (EU) .../... of XXX on standard contractual clauses for the transfer of personal data to third countries pursuit to Regulation (EU) 2016/679 of the European Parliament and of the Council", and they were put in the public comment. This paper outlines the trends in these "Supplement Measures" and new Standard Contractual Clauses.
