欧州一般データ保護規則 （GDPR） はデータ主体の権利規定を中心に，管理者及び処理者に厳格な個人データ保護義務を課している．その対象はあらゆる個人データの処理に及ぶが，2 つの学術目的例外規定が存在し，学問の自由の配慮が見られる．一つは，学術目的の表現の自由を含む 85 条であり，もう一つは，科学調査又は歴史調査目的の特例を含む89 条である．これらはいわゆる開放条項であり，加盟国法が例外事由を設定することとしているが，その内容及び運用については未整理であるといえる．本発表では，GDPR85 条及び 89 条を分析すると共に，実務的な対応をも模索する． |

The General Data Protection Regulations (GDPR) of the European Union impose strict personal data protection obligations on managers and processors, with a focus on data subject rights provisions. Although the object covers the processing of all personal data, there are two Academic Research Exclusion Clauses and consideration of academic freedom is seen. One is Article 85, which includes freedom of expression for academic purposes, and the other is Article 89, which includes special cases for scientific research or historical research. These are so-called open clauses, and exceptional cases are to be set out by the Laws of Member States. However, it can be said that their contents and operation are unprocessed. In this paper, Article 85 and Article 89 of the GDPR are analyzed and practical measures are considered. |
