いわゆるAIに関する国際規制動向調査報告～EUにおけるAI法検討経緯の概観～ International regulatory trend survey report on AI: Overview of the process of discussion on AI legislation in the EU 加藤, 尚徳 村上, 陽亮 Naonori, Kato Yosuke, Murakami AIと社会 2024 年 7 月 12 日，Artificial Intelligence Act（AI Act，以下 AI 法）が EU 官報に掲載された．2021 年 4 月に欧州委員会によって同法案が提案されて以降，2023 年 5 月には欧州議会による修正案が公表され，その後，EU 理事会を含めた三者対話が進められてきた．これらの過程においては，欧州委員会が提案した原案に対して，いくつもの修正が加えられている．最終的に EU 官報に掲載された AI 法を理解するためにも，欧州委員会によって提案された当初の法案に対して欧州議会がどのような修正を加え，さらにそれらが三者対話の中でどのように収斂したかを分析することは有益である．本稿においては，AI 法検討過程の概観をつうじて，議論の経緯を分析し，EU における AI 規制の議論において重視される価値観が何かについて検討を行う． On July 12, 2024, the Artificial Intelligence Act (AI Act, hereafter AI Act) was published in the Official Journal of the EU. Since the bill was proposed by the European Commission in April 2021, an amendment by the European Parliament was published in May 2023. Later, a trilogue has been underway with the addition of the Council of the European Union. During these processes, a number of modifications were made to the original draft proposed by the European Commission. In order to understand the final AI Act published in the Official Journal of the European Union, it is useful to analyze how the European Parliament made amendments to the original bill proposed by the Commission, and how these amendments converged in the trilogue.
