サイバー防御時の法的論点の洗い出し Identifying legal issues of cyber defense 須川, 賢洋 Masahiro, Sugawa セキュリティ 重要インフラを始めとする国内の様々なネットワークシステムを外部の攻撃から防御する必要性が叫ばれているが，その対処には法律上に不明瞭な点が多い．特にそれは有事よりもその前段階の緊張時に顕著である．しかしながら防衛三文書の公開を転記に我が国の法制にも「能動的サイバー防御」の考え方が取り入れらルことになった．そこで本報告では，このような問題を今後研究していくために，サイバー防御に関する法的な論点をカタログ的に洗い出してみることとする． The need to protect various domestic network systems, including critical infrastructures, from external attacks has been called for, but there are many unclear points in the law regarding how to deal with these issues. This is especially true in times of pre-stress rather than in times of emergency. However, with the release of the defense three documents, the concept of "active cyber defense" has been introduced into Japan's legislation.
