法執行指令（LED）第37条に関するガイドライン01/2023（Guidelines 01/2023 on Article 37 Law Enforcement Directive）の意義と展開 板倉, 陽一郎 寺田, 麻佑 Yoichiro, Itakura Mayu, Terada EIP+CSEC (1) 法執行指令（LED）第 37 条に関するガイドライン 01/2023（Guidelines 01/2023 on Article 37 Law Enforcement Directive）は，法執行指令における移転の要件に関して，EDPB（欧州データ保護ボード）が公表したガイドライン案である．日本は，欧州から，GDPR（一般データ保護規則）における十分性は取得しているが，LED における十分性は取得していない．そうすると，LED 第 37 条に基づく移転の要件は重大な関心事である．本稿では，同ガイドライン案を紹介するとともに，日本に関係する意義，そこからの展開を紹介する． Guidelines 01/2023 on Article 37 Law Enforcement Directive (LED) is a draft guideline published by the EDPB (European Data Protection Board) on the transfer requirements of the Law Enforcement Directive. The draft guideline is available on the EDPB website. Japan has obtained sufficiency under the GDPR (General Data Protection Regulation) from Europe, but not under the LED. Then, the requirement of transfer under Article 37 of the LED is a matter of serious concern.
