オープン・グラフ・プロトコルに関する著作物利用許諾契約 Copyright Licensing Agreement concerning Open Graph Protocol 小池, 誠 Makoto, Koike オープン・グラフ・プロトコル OGP がソーシャル・ネットワーキング・サービス SNS を中心にインターネットを席捲しているが，第三者が OGP に起因して画像データ，ウェブサイトの概略などをウェブサイトに転載する行為について，著作物利用許諾契約が成立するか否か検討した．OGP に伴って，デジタルコンテンツを転載する行為は，ブラウザに搭載されている通信プロトコル，即ち，ハイパーテキスト・トランスファー・プロトコルを介して，著作権者のウェブサーバーに対して著作物の利用を申込み，その後，著作権者のウェブサーバーが，ウェブページのヘッダー内に記載した OGP のメタタグで自動的に申込の承諾を行っているので，著作物利用許諾契約が成立すると解する．この解釈では，OGP による著作物の転載は，自動販売機による現実売買と同様となる．事案によっては，ウェブサイト利用規約のような利用規約は，令和 2 年 4 月 1 日に施行された改正民法に定める定型約款に該当すると解される． Open Graph Protocol (OGP) has been increasingly widespread in the internet community such as social networking service, and the open graph meta tags allow to generate the title of the webpage, the image data, the description of a website and so on in another website. Herein I present legal analysis whether the generation of the digital data in a webpage with a hyperlink through OGP meta tags is based on a copyright license agreement in the framework of Japanese Civil Law. An offer to use the copyrighted work in a digital data set by OGP meta tags is transmitted to the webserver of the copyright owner through the hypertext transfer protocol in the browser of the terminal of an end user, and the webserver automatically accepts the offer through the OGP meta tags in the header, thereby forming the copyright license agreement.
