自動運転を見越した法律と責任論の考察1 Consideration of law and responsibility theory in anticipation of autonomous driving, part1. 須川, 賢洋 Masahiro, Sugawa 一般講演6 自動運転の法律問題はレベルごとに分けて考えるべきである．本稿では，まずレベル 3 に合わせて改正された道路交通法と道路運送車両法について検討し，自動運転は未だ「機能」ではなく「装置」の一つにすぎないことを解説する．その上で，レベル 4，5 になった際には製造物責任法を始め多くの現行法が通用しなくなる問題があることを指摘し，レベル 5 が実用化された場合の将来の法制度がどうあるべきかを検討する素材としている． The legal issues of autonomous driving should be considered separately for each level. In this paper, I first consider the Road Traffic Act and the Road Transport Vehicle Act revised for Level 3, and explain that autonomous driving is still just one of the "devices", not the "functions". Next, I pointed out that there is a problem that many current laws such as the Product Liability Act will not be applicable when Levels 4 and 5 are reached.
