ライフサイクルの短いイノベーション時代における発明の単一性審査基準のあり方 Way of the Patent Examination Guidelines about unity of invention in the innovation era having a short product life cycle 近島, 浩 平塚, 三好 Hiroshi, Chikashima Mitsuyoshi, Hiratsuka イノベーションと特許 今般の製品ライフサイクルの短い時代においては、特許権の早期権利化が重要となる。本稿では、現行の発明の単一性要件・シフト補正の禁止の規定によって、特許権の早期権利化が阻害されている点を指摘すると共に、その解決策を提示する。より具体的には、発明の単一性要件・シフト補正の禁止の運用において重要となる STF の 「直列的な」 認定手法が、出願人にとって酷になるケースを例示し、これを解決する STF の新たな認定手法を提案する。 In this era of short product life cycle recently, it is important to establish a patent right earlier. In this paper, we point out the inhabitation of early establishment of a patent right because of the requirements of unity of invention and the provision to prohibit making an amendment that changes special technical features(STF). Then, we present their solution.
