• 論文抄録 / 内容記述: 作権法では私的領域への課金として私的録音録画補償金制度がもうけられている。一方で、昨今の技術的な進歩に伴って、技術的保護手段も多様化してきた。このような中、私的録音録画補償金制度と技術的保護手段の関係性が争点となった争いが生じた。加えて、欧州司法裁判所でも同様の構図をもった争いが生じている。本稿では､私的録画補償金と技術的保護手段について著作権法の視点から分析を行い､課題を明らかにする。また、昨今の権利者団体の提案を踏まえつつ、今後の制度のあり方について新しい分析手法を提案する。

• 論文抄録(英) / 内容記述: The compensation for private sound and visual recording to charge for the private uses of contents was established in Japanese copyright law. On the other hand, various technological protection measures are used in these days. Between them, a conflict occurred as a lawsuit. In addition, a lawsuit based on same issue occurred in EU. In this paper, we organize that from the viewpoint of Copyright Law and propose new way of analysis to clarify the definitions for new institution.
