• 論文抄録 / 内容記述: クラウド環境に置かれたコンテンツの利活用が着目されている．著作物がクラウド環境でグローバルに利活用されるとき，著作権と関連権との関係および copyright との対応関係が明確にされなければならない．ここで，わが国の著作権と関連権は，著作権，著作者人格権，出版権，実演家人格権，著作隣接権で捉えられよう．そこで，本稿は，国際著作権法界に現存する author's right アプローチと copyright アプローチとを架橋し，それら権利を人格的権利と経済的権利との相互関係から分析する．

When copyrighted works in cloud environment is used globally, relation of copyright and related rights has to be clarified, as well as correspondence relation with copyright. Here, copyright and related rights in our country can be understood as economic rights of author, moral rights of author, publication right, moral rights of performer and neighboring rights. In this report, therefore, the copyright approach and the author's right approach existing in the world of international copyright law is bridged, and those rights are analyzed from the reciprocal relation between moral rights and economic rights.
