• 論文抄録 / 内容記述: 個人情報保護法は遵法意識を高めた反面、「過剰反応」 など幾つかの不具合も生じさせた。その主因は、従来の情報財の保護方式が 「秘密型」 と 「知的財産型」 に分断されており、第 3 の類型として 「個人情報型」 を早急に定立することが、困難な点にある。そこで、人格権をとりあえず捨象した 「個人データ」 を対象に、alienable なものとして扱うための法的な方法論として、アメリカ著作権のアナロジーの適用可能性を追求した。

• 論文抄録(英) / 内容記述: Personal Data Protection Act made fully effective in 2005 in Japan, enhanced a sense of compliance, but generated several inconveniences as well. It was an ambitious but not successful effort to legitimate the third type of protection for information, following ‘secrecy’ (the first type) and ‘intellectual property’ (the second). In this paper, theauthors re-examine several methods, including the possibility of applying American copyright concept as an analogy, where moral right is excluded and copyright is treated as a kind of property, namely alienable object.
