• 論文抄録 / 内容記述: 我が国の刑事法におけるInternet上のポルノグラフィーの規制については、HDDを有体物に見立てて「わいせつ物の陳列罪」とするのが最高裁の判例である。しかし、最近の下級審判決では、Internet上の児童ポルノへの対応について、陳列罪にするか販売罪にするか、再び動揺を生じている。従来の判例から最新の判決までを概説し、ネットへの対応可能性を論じる。

• 論文抄録(英) / 内容記述: The Supreme Court of Japan held that, on the grounds that a hard disc drive is equivalent to a “tangible object,” the Public Exhibition of Obscene Object section under the Japanese Criminal Law applies to and prohibits pornography on the Internet. Lower Courts in Japan, however, have been divided recently in opinion over which provision of the Public Exhibition of Obscene Object section or the Distribution of Obscene Object section applies to child pornography on the Internet. I will review a wide range of court decisions including the latest and analyze the applicability of the current statutes and precedents to issues on the Internet.
