• 論文抄録 / 内容記述: 日本を含む先進諸国は‘国際競争力’の強化が求められており、知的財産制度は国際競争力の源泉のひとつであり、産業構造の高度化に大いに資するものだと信じられている。そのとき、一般に体系化された知的財産権の保護の強化が目指されるが、知的財産の種別に応じた仕組みが望まれ、権利保護一辺倒では逆に新たな優れた知的財産の創出を阻害しかねない場合があり得る。先進諸国と多国籍企業が発展途上国の物理的、文化的資源の搾取を許すような仕組みは国際的なバランスを失しているように思われるし、国内的にも知的財産権一般につき濫用という法理の確立が望まれる。

Intellectual property system is a resource of international competitive power among all nations, and supports industrial infrastructures. Many countries are apt to strengthen intellectual property rights. But it is not necessary rational. The world has to go toward making a well-balanced framework of general intellectual property legal system nationally and internationally.
