• 論文抄録 / 内容記述: 英国のデータ保護法1998における報道に対する適用除外の用件および実務をわが国の個人情報保護法案におけるマスメディアの反対論と比較するとき、基本原則の適用の有無、除外用件の広狭、除外の認定の実務の手続的な観点などの問題が比較法的な問題点として意識されるべきことに関心がもたれる。これらの対照となる点について、具体的にその相違点を意識することは、非常に興味深く、また、わが国における立法にさいしてもきわめて示唆的である。とくにわが国において、自主的な苦情処理等の機関の設立およびその活動が社会的に信頼される程度に至るか否かが、全面的な適用除外を認めるか否かの重要なポイントになることがわかるであろう。

• 論文抄録(英) / 内容記述: Comparing the Exemption for Special Purposes of the Data Protection Act 1998 in UK with proposed Personal data protection law in Japan, we find many differences in many points such as application of the basic principles, scope of the requirements of the journalism and practise of the procedure. When we find out such differences in details, such differences are very informative and suggestive for the discussion of data protection system in japan. Especially, the establishment of the Codes of Practise and independent bodies are necessary for the journalism to insist the wide range of exemption.
