• 論文抄録 / 内容記述: 名誉毀損やプライバシー侵害に関する不法行為責任が争われる際に，求められる法的救済としては，損害賠償請求と，差止請求がある．表現行為の差止請求については，表現の自由に対する影響が大きいことから，慎重に判断されるべきという考え方があり，そのような立場に立った裁判例も多い．一方で，インターネット上の媒介者であるプラットフォーム事業者，SNS，ISP 等に，利用者の発信情報の削除を求める際には，差止請求が認められやすい場合があるという指摘がある．表現者に対する差止と媒介者に対する差止では性格が異なる事によると考えられる．本稿では，インターネット上の媒介者責任に関する係争例における，損害賠償請求と差止請求の関係について考察する．

• 論文抄録(英) / 内容記述: The legal remedies for defamation or invasion of privacy include claims for damages and injunctions. Claims for injunctions restricting expression could threaten the free speech and courts usually take strict stance to issue such injunction. However, it is pointed out that such injunction could be issued more easily on service providers such as SNS, ISP, or BBS than that on writers or speakers. This paper focuses on the necessary conditions for such remedies for defamation or privacy invasion on the Internet.
