• 論文抄録 / 内容記述: 機械学習においては，学習のためにデータの入力が必要となる．このデータの入力においては，入力されるデータに関する著作権が問題となりうる．我が国の著作権法においては，第 47 条の 7 （情報解析のための複製等） が権利制限の一つとして定められているため，この入力データに関する権利上の問題を解決しうる．他国の法制度においては，このような権利制限に非営利の限定も設けられている中，我が国はより広い権利制限が認められており，「機械学習パラダイス」 とも呼ばれている．他方で，このような権利制限が無制限に認められるかについては疑問がある．立法が検討される段において，今日のような大規模なデータを用いた機械学習が前提となっていのだろうか．そこで，本稿においては，著作権法第 47 条の 7 の趣旨を再考察する．その上で，今後の機械学習に向けた著作権法のあり様について議論する．

• 論文抄録(英) / 内容記述: In machine learning process, it is necessary to input data for learning. In inputting data, copyright regarding input data may be a problem. According to the Copyright Law in Japan, Article 47-7 (Reproduction, etc. for data analysis) is established as one of the limitations on copyright. There are similar systems in other countries, but it is limited to non-profit purposes. Copyright Law in Japan has a wider range of the limitation on copyrights and is also called "machine learning paradise". On the other hand, there is a doubt as to whether such a right limitation is unlimited. About ten years ago when this limitation was examined, was it supposed to analyze large-scale data like today ? Therefore, in this paper, we reconsider the purpose of Article 47-7 of the Copyright Law. Then we discuss about the copyright law for future machine learning.
