• 論文抄録 / 内容記述: 本稿は， ''Scored Society" において，プライバシーの利益の一側面である 「自己像の同一性」 (personal identity) の利益がどのような影響を受けうるか検討するものである． "Scored Society" とは，ピッグデータをデータマイニングし私たちの人物像がプロファイリング （判断・評価） され，結婚相手や従業員としての望ましさや，借り手としての信用，消費者としての支払可能性など，さまざまな身体的・心理的・社会的な性質が数量化・点数化して比較される社会のことをいい，法学者 Citron と Pasqual が創出した用語である．他者の特性について一見客観的根拠に基づいて判断できるという理由から，自動化した人物評価の点数化は普及すると考えられる．ところが，何らかの理由から点数化に歪曲があったり，バイアスがかかっていたとしても，点数が低ければ私たちの人物像の同一性は傷つけられ，危害を受ける可能性があり，ひいては私たちの人生にも深刻な帰結がもたらされるだろう．点数による評価・比較システムそのものも，評価・比較のアルゴリズムやメカニズムに関しても，不正な点数の最適化を避けるため，秘密にされる可能性が高い．したがって，不当に点数が低かったとしても，その点数も基礎となるデータについても修正を行うことが困難である．「忘れられる権利」 や 「プロファイリングされない権利」 は "Scored Society" の危害を低減するかもしれないが，どこまで危害を低減できるか，実際に危害を低減できるのかは明らかではない．むしろ，私たちは点数を低くするネガティブな自己情報を減殺しかき消すために，ポジティブな自己情報を提示し，拡散するべきかもしれない．そうすると，現代におけるプライバシー保護は，自己情報を隠蔽することではなく，むしろ自己像のポジティブな側面の積極的開示によって実現されることと考えられる．

• 論文抄録(英) / 内容記述: This paper explores the problems involving "personal identity," an aspect of privacy interests, in the "scored society," a term juridical professors Citron and Pasqual coined to depict a society in which every one of our physical, mental, and social qualities such as desirability as a marital partner or as an employee, credibility as a borrower, and payment capacity as a consumer—is rated and ranked by mining Big Data and profiling our personal identity. The automated scoring will be pervasive in our society, because we want to judge other persons easily based on apparent objectivity. But a low score might harm our personal identity and create severe consequences for our life, even though the score might be biased or distorted for some reason. The scoring system itself and its algorithms and criteria are generally opaque to avoid unjust scoring optimization, so it is difficult for us to amend the score and the data on which the rating is based. Implementing the "right to be forgotten" or the "right not to be profiled" might reduce the harm of the "scored society," but we have little confidence that that will be the case. Instead, we should present and disseminate the positive information about ourselves draw out the negative information that might lower our score. Consequently, a measure of privacy protection in our era is available not by hiding our information but rather by aggressively revealing the positive features of our identity.
